MEDIATION

CH.Mediation

Carolyn E. Hansen, ESQ.

Carolyn is an experienced mediator, lawyer and healer who brings a quick mind and centering presence to mediation. For 12 years she has maintained a private mediation practice and also mediated commercial and family law disputes referred by town and family courts. She is hired by parties to mediate disputes before litigation. Because of her extensive cross cultural expertise she was chosen to mediate an international commercial dispute in Mandarin Chinese in New York City.
She is a member of the Executive Committee of the Dispute Resolution Section of the New York State Bar Association and co-chair of its Diversity Committee. Carolyn is on the approved panel of mediators for the Supreme Court, Commercial Division, Nassau County.

As a member of the International Academy of Law and Mental Health she is active in the international movement for therapeutic jurisprudence which brings psychology into the training and practice of law. Her expertise includes cross cultural mediation. With a JD from the University of Michigan and an LLM. from the University of Brussels, Belgium, her commitment to healing and peace is reflected in her participation from 1999-2006 on the board of International Alliance of Holistic Lawyers and currently in the Project of Integrating Spirituality, Law and Politics. In 2001 she completed New York State mediation training and numerous specialized trainings in mediation since. Carolyn also has a Bachelor of Science in Healing. From 1997-1999, she taught Chan (Zen) meditation at the main monastery of the Dharma Drum Mountain Organization in Tapei, Taiwan.

Carolyn has extensive experience in U.S. and international commercial law, business law, non-profit organizations, and also mediates family matters. She prepares agreements reflecting the mediation outcome as well as uncontested divorce filings.

Individuals and business entities are increasingly using mediation to resolve disputes. It can be faster, less expensive, and less stressful than litigation. In mediation, the parties have the psychological benefit of controlling the outcome. Because of her experience as a lawyer, healer, and meditation teacher, Carolyn brings a unique presence to mediation. Mediation provides a venue for the parties to come together to present the facts and issues and to reach an agreement. The role of the Mediator is to provide a safe venue where necessary discussion can occur and to ensure required information is available and understood. The Mediator supports the parties in reaching an agreement, but does not dictate the terms. The parties create the terms based on their unique and in-depth understanding of the matter in dispute. The Mediator is not a judge or arbitrator. Around New York City, the State Supreme Courts' Commercial Divisions and the United States Federal District Courts refer litigation matters to qualified panels of mediators. Carolyn is on such a panel. In the Hudson Valley, family and town courts may refer matters for mediation. Often mediation occurs because the parties decide to use it before litigation.

In International Mediation, Carolyn assists parties in overcoming cultural misunderstandings. She also prepares the agreements for parties to sign reflecting the mediation outcome.
